Condominium Law
Application of Condominium Law No. 634: correction of land shares, the distinction between common areas and appurtenances, common-expense obligations and management disputes.
Condominium law governs separate ownership of the independent units of a building and co-ownership of the land share attached to each unit. Creating floor easements and condominium ownership, the management plan, use of common areas and contributions to common expenses are its core subjects.
Actions to annul owners' assembly decisions, service-charge and advance claims, interference with common areas and correction of land shares are among the most frequent disputes in apartment buildings and residential sites. Since 2023 many disputes under the Condominium Law must first go to mediation before a lawsuit can be filed.
