Thoughts on Current Application Errors Regarding Law No. 6306
Abstract
The illegal application of the law which was enacted on the official gazette of May 31st 2012 number 28309 with the name “Law on the Conversion of the Areas under the Risk of Catastrophe” which is colloquially called “Urban Transformation Law” by the governmental bodies through the breach of mandatory provisions are being subject to criticism. The purpose of this article is to briefly explain the relevant provisions and principles of the Law 6306, to set forth the legal consequences to which the governmental bodies will be subject as a result of their behavior against the law and to seriously warn their officers regarding the authority of the governmental body to have a recourse against such officers concerning damages arising from an earthquake and finally bring suggestions for a better application of the law regarding de lege feranda. 1 Maltepe Üniversitesi Hukuk Fakültesi Özel Hukuk Ana Bilim Dalı, Galatasaray Üniversitesi Hukuk Fakültesi Misafir Öğretim Üyesi 2

“Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun” başlığı ile 28309 sayılı resmi gazetede 31.05.2012 tarihinde yayımlanarak yürürlüğe giren ve kısaca halk arasında “Kentsel Dönüşüm Yasası” olarak ifade edilen yasanın emredici hükümleri karşısında idari mercilerin hukuka aykırı olarak yasayı uygulamamaları eleştiri konusudur. Bu makalenin yazılma amacı 6306 sayılı yasanın ilgili hüküm ve ilkelerini kısaca açıklayarak, idari mercilerin bağlı yetkilerine rağmen yasaya karşı takındığı tutuma dayalı olarak hangi hukuki sonuçlara tabi olacakları ve oluşacak bir depremde doğacak zararlardan idarenin tazmin yükümlülüğü sonucu görevi yerine getirmeyen memurlara rücu yetkisi konusunda ciddi uyarılar yapmak ve olması lazım gelen (de lege feranda) açısından yasanın iyi uygulamasına yönelik öneriler getirmektir
