Misconceptions in the Process from Old Land Share to Shared Ownership and New Land Share in Urban Transformation Applications
Abstract
In this study; the fact that the current rights of the right owners regarding the state of the building within the scope of urban transformation before the transformation vary with transformation applications during the realization of urban transformations, the effect of the land shares that were incorrectly registered on the transformation and the subsequent results have been evaluated. In addition, the concept of land share, the transition to condominium ownership, the transformation of the share into land share, the reevaluation process within the scope of Law No. 6306 have been tried to be explained

Bu çalışmada; kentsel dönüşüm uygulamalarının gerçekleştirilmesinde, kentsel dönüşüm kapsamında kalan bir yapının dönüşüme girmeden önceki durumunda hak sahiplerinin mevcut bulunan haklarının dönüşüm uygulamaları ile birlikte değişkenlik göstermesi durumu, daha önceki durumunda hatalı kaydedilen arsa paylarının yapılacak dönüşüm uygulamalarına etkisi ve sonuçları üzerinde değerlendirmede bulunulmuştur. Ayrıca arsa payı kavramı, kat mülkiyetine geçiş ile payın arsa payına dönüşmesi, 6306 sayılı Kanun kapsamında yeniden değerlendirme süreci açıklanmaya çalışılmıştır
