Provisions and Consequences of Distributing an Existing Mortgage to Multiple Immovable Properties According to Article 889 of the Turkish Civil Code (TMK)
Abstract
In practice, the transformation of existing mortgages on immovable properties following the subsequent establishment of condominium ownership or construction servitude has led to significant legal uncertainties. Although Article 889 of the Turkish Civil Code provides a regulatory framework concerning certain dispositions-such as partition or transfer of shares-on land subject to an existing mortgage, it remains silent on the legal consequences of transitioning to condominium or construction servitude. This gap has created widespread issues, particularly in large-scale residential projects where a single mortgage established on the land is erroneously and unlawfully extended to each individual unit without apportionment during the transition to condominium ownership. As a result, consumers acquiring a single unit are confronted with an undivided mortgage burden. This article examines the legal implications arising from such mortgage transformations, focusing on the non-mandatory nature of Article 889. It further explores the inconsistencies stemming from erroneous practices based on the provisions of the Land Registry Regulation. The study aims to propose solutions by analyzing the conflict between the rights of mortgage creditors and the interests of condominium owners (or holders of construction servitude)

Günümüzde mevcut ipotekli taşınmazlar üzerinde sonradan kat irtifakı ya da kat mülkiyeti kurulması hâlinde, ipoteklerin nasıl bir dönüşüme uğrayacağı uygulamada ciddi sorunlara neden olmaktadır. Türk Medeni Kanunu m. 889 hükmü, mevcut bir ipoteğin varlığı sonrası arazi mülkiyetine bağlı bazı tasarruf işlemleri ile ilgili olarak düzenleme getirse de (bölünme, pay devri) uygulama sorunları daha çok metin içinde yer almayan kat mülkiyeti/ kat irtifakı tesisine bağlı olarak doğmaktadır. Büyük ölçekli konut projelerinde, arazide tek bir ipotek tesisini takiben kat mülkiyeti oluşumunda mevcut ipotek miktarı, kanuna aykırı hatalı uygulama ile, tüm bağımsız bölümler üzerine bölünmeden yansıtılmaktadır. Böylece, tüketiciler bir bağımsız bölüm edinmeleri halinde bölünmemiş ipotek yüküyle karşılamaktadır. Makalemiz, TMK m. 889 düzenlemesinin emredici olmayan hükmü sonucu, ipoteğin dönüşüm sorunlarını incelemektedir. Tapu Sicili Tüzüğü’nün düzenlediği hükümlerin hatalı hale gelmiş uygulamalarına dayalı hukuka aykırılıkları irdelemeye yöneliktir. Çalışmamızda, ipotek alacaklısının menfaati ile özellikle kat maliklerinin (veya kat irtifakı sahiplerinin) yararları arasındaki çatışma detaylı biçimde ele alınarak çözüm getirmeye yönelik olacaktır
