Criticisms of the Restriction on the Disposition of Agricultural Lands Based on Joint Ownership and the Implementation of Converting It into Cash by Eliminating the Shared Status through Forced Increase
Abstract
This article examines the legal challenges arising from the application of co-ownership regimes—specifically, tenancy in common and joint ownership—within the framework of the provisions introduced by Law No. 5403 to prevent the division of agricultural lands. It argues that the notion of “share” applies exclusively to tenancy in common, and critically assesses the consequences of misapplication of the law, as well as incorrect interpretations and practices in this context, in light of the Supreme Court’s jurisprudence

CRITICISMS OF DISPOSAL RESTRICTIONS AND COMPULSORY PARTITION BY AUCTION IN JOINTLY OWNED AGRICULTURAL LAND Bu çalışma, 5403 sayılı Toprak Koruma ve Arazi Kullanımı Kanunu ile getirilen tarım arazilerinin bölünmesini önleyici hükümler çerçevesinde, birlikte mülkiyet (paylı mülkiyet ve elbirliği mülkiyeti) türlerinde ortaya çıkan hukuki sorunları ele almaktadır. Çalışmada, pay kavramının yalnızca paylı mülkiyet için geçerli olduğu, Yargıtay kararları ışığında, hatalı uygulamaların sonuçları eleştirilmektedir
