Evaluation of the Provisions and Consequences of Existing Mortgages on Real Estate Within the Framework of Construction Projects After the Transition to Floor Service Ownership - Floor Ownership from the Perspective of Consumer Law
Abstract
Today there are a lot of projects, in which prepaid housing sales, which are equivalent to sell-built for residences and workplaces, are widely seen. The contractors use very high amounts of loans in the first stage of the project, and within the framework of these loans, a mortgage is established in favor of the bank on the real estate where the project is made. In case of establishment of condominium servitude or condominium ownership on the immovable in the later stages of the project, in practice, the existing mortgage is moved to the independent section pages opened in the condominium registry over the whole amount of the first established mortgage. When most of the consumers buy independent sections from the projects, they gain ownership by being loaded with an amount that is much more than the value of the independent section, almost the value of the entire project; they either do not realize this situation or they think that even if they do, it will not be a problem. In the event of a sale by converting the mortgage into cash, consumers are aware of the situation and have to endure the sale of the independent section they purchased. This practice is contrary to article 889 of the Turkish Civil Code. In practice, it is obligatory to correct this unlawful situation that arose due to the practice of title deed. What needs to be done for this is the implementation of the provision of Article 889 of the Turkish Civil Code and the transfer of the existing mortgage amount to the land registry in proportion to the values of the independent parts. Günümüzde konut ve işyerine yönelik sat-yap muadili yapılan ön ödemeli konut satışları yaygın bir şekilde görülmektedir. Bu şekilde yapılan projelerde yüklenicilerin ilk aşamada oldukça yüksek miktarlarda kredi kullandığı, bu krediler çerçevesinde projenin gerçekleştirildiği taşınmaz üzerinde banka lehine ipotek tesis edildiği görülmektedir. Taşınmaz üzerinde projenin ilerleyen aşamalarında kat irtifakı ya da kat mülkiyeti kurulması halinde, uygulamada mevcut ipotek kurulduğu miktar üzerinden, kat mülkiyeti kütüğünde açılan bağımsız bölüm sayfalarına taşınmaktadır. Tüketicilerin çoğu projelerden bağımsız bölüm satın aldıklarında, bağımsız bölümlerinin değerlerinden çok fazla, neredeyse projenin tamamının değerine yakın bir miktarla yüklü olarak mülkiyeti kazanmakta; bu durumun ya farkına varmamakta ya da farkına varsalar bile sorun olmayacağını düşünmektedirler. İpoteğin paraya çevrilmesi yoluyla satış yapılması ihtimalinde tüketiciler durumdan haberdar olup, satın aldıkları bağımsız bölümün satışına katlanmak zorunda kalmaktadırlar. Bu uygulama Türk Medeni Kanun madde 889’a aykırıdır. Uygulamada tapu uygulaması nedeniyle ortaya çıkan bu kanuna aykırı durumun düzeltilmesi zorunludur. Bunun için yapılması gereken ise, TMK m.889 hükmünün uygulanması ve mevcut ipotek miktarının bağımsız bölümlerinin değerleriyle orantılı olarak tapu kayıtlarına taşınmasıdır.
